1976 Re-certification of a construction permit

Identification of the claimant: Verification if the claimant is rightful.
Required documents (Completing Documentation):
1. Property document proving that the assignor is: (the applicable)
– the owner of the property;
– the person to whom construction right was established;
– the person who has the right to build on other’s property by force of special law.
2. The original of the construction permit;
3. Documents providing evidence for the extent of completion of the construction and installation works to the date of expiry of the legal power of the construction permit;
4. Filled-in form (Appendix № 1 of Instruction № 3 from 17.12.2001 for application of section ІV of Tariff № 14 for the fees, collected in the system of the Ministry of Regional Development and Public Works and by the Regional governors) specifying the value of the fee. The assignor may attach a notarised declaration for the building value of the construction;
5. Document for payment of the due fee unless the payment has been performed electronically.
Explications: The constructions for which the construction permit has lost its legal power may be completed after re-certification of the same. Re-certification of the construction permit may be requested by the assignor of the construction in three months’ time after the expiry of the respective period within the meaning of Art. 153, Para. 2 of the Spatial Development Act (SDA). The construction permit may be re-certified only once – to renew the period for beginning of the construction or to renew the period for completion of the construction. Re-certification is done by an entry onto all of the originals of the issued construction permit. Information for the re-certification is published on the official website of the administration in the public “Register of issued construction permits”. A copy of the re-certified construction permit is sent to each of the municipal administrations concerned. Refusal to re-certify the construction permit is issued with an order of the Regional governor, communicated to the interested persons under Art. 149, Para. 2 of the SDA according to the provisions of the Code of Administrative Procedure.

The value of the fee is determined in compliance with Art. 29, Para. 4 of Tariff № 14 for the fees, collected in the system of the Ministry of Regional Development and Public Works and by the Regional governors and equals to 50 percent of the fee under Art. 29, Para. 1, 2 or 3 of Tariff № 14.
The due fee can be paid:
– By bank card via real POS terminal in the Administrative services unit;
– In cash on the counter of the Regional administration Veliko Tarnovo;
– By bank on the account below:

– in the Administrative service unit, personally or by an authorized representative;
– through a licensed postal operator at an address, specified by the claimant, whereas the claimant declares that the postal charges are at his/her expense, payable upon receipt.
