Identification of the claimant: Verification if the claimant is rightful.
Required documents (Completing Documentation):
1. Documents certifying the claimant as an interested person under the meaning of Art. 131, Para. 1 of the Spatial Development Act (SDA);
2. Outline with a proposal for the requested change of a detailed development plan according to Art. 135, Para. 2 of the SDA;
3. Statement of the mayor of the municipality according to Art. 135, Para. 4 of the SDA;
4. Documents in compliance with the provisions of Art. 62, Para. 2 and 3 of the SDA when a change of the designation of territories is requested.
Explications: The service is provided in accordance with the legal powers of the Regional governor under the Spatial Development Act to a claimant who is an interested person under the meaning of Art. 131, Para. 1 of the SDA. Drawing up of a design for the change of a detailed development plan is granted or refused to grant by an order of the Regional governor. The permitting order suspends the application of the development plans in force in the parts which it concerns. The design for change is proceeded according to Section III of Chapter 7 of the SDA. The order is forwarded to the respective municipal administrations for announcement according to the provisions of Art. 124b, Para. 2 of SDA to the interested persons under Art. 131 of the SDA and is published on the official website of the administration in the public “Register of acts issued for working out and approving of development plans and their changes”.
