1962 Issue of a commissioning certificate of a construction

Identification of the claimant: Verification if the claimant is rightful.
Required documents (Completing Documentation):
1. A document for ownership or a document for established construction right on other’s property or a document for the right to build on other’s property by force of special law;
2. Ultimate report* prepared by the person, exercising construction supervision;
3. Construction permit (act for legalization) – to be attached ex-officio;
4. Record for defining the construction line and level with the results from inspections of the controlled levels reached – to be attached ex-officio;
5. Act (sample 14) for acceptance of the construction of the building, when required;
6. Statement act under Art. 176, Para. 1 of the Spatial Development Act (SDA) for determining the exploitation fitness of the construction for its acceptance, sample № 15 of Ordinance № 3 from 31.07.2003 for preparing and signing acts and protocols during construction;
7. Information for the identifier of the cadastral object to be commissioned; for the constructions under Art. 32, Para. 1, item 1, letters “b” and “g” of the Cadastre and Property Register Act (CPRA) which impose zones with restrictions on land properties, a certificate is attached for their reflection in the specialized maps and registers under Art. 32 of the CPRA, issued by the Geodesy, cartography and cadaster agency;
8. Contracts with the respective operating companies for connecting to the technical infrastructure networks when necessary;
9. A technical passport, and – for new buildings – an energy performance certificate for a new building, issued in compliance with the ordinance under Art. 48 of the Law on Energy Efficiency;
10. Acts under special laws required for commissioning the construction;
11. Authorisation (when an authorized agent applies);
12. Document for payment of the due fee unless the payment has been performed electronically.
Note: Ultimate report is not attached for constructions under Art. 14, Para 2 of the Law on the Construction Chamber, unless a contract is signed with a person exercising construction supervision on request of the assignor, as well as for the constructions of fifth category with the construction permit issued before entering into force of the Act, amending and supplementing the Spatial Development Act (publ. – SG. 25/26 Mar 2019).
Explications: The commissioning certificate is issued by the Regional governor to the assignor of the construction for constructions of fourth and fifth category for which the Regional governor has issued the construction permit. The certificate is issued upon checking the completeness of the set of documents and registration of the construction commissioning, using a template – Appendix № 2 to Art. 19a, Para. 1 of Ordinance № 2 from 31.07.2003 for commissioning of constructions in the Republic of Bulgaria and minimum warranty periods for executed construction and installation works, facilities and construction sites. At the discretion of the body site inspection can be carried out, for which a statement act is prepared and signed, which is an integral part of the file of the construction. The commissioning certificate of the construction is published on the official website of the administration in the public „Register of issued commissioning certificates“. A justified written refusal to issue a commissioning certificate is given if any of the circumstances provided under Art. 178, Para. 3 of SDA is present, or in the case that, for constructions of forth category – construction supervision has not been exercised or has been exercised by a person unlicensed or unregistered for the purposed, or, for constructions of fifth category – technical management has not been exercised. The issued commissioning certificate or the refusal to issue such is delivered to the assignor in person or to someone authorised by him/her for the purpose.

The value of the fee is determined according to the type of the construction following the provisions of Art. 31c, Art. 31d and Art. 31e of Tariff № 14 for the fees, collected in the system of the Ministry of Regional Development and Public Works and by the Regional governors.
The due fee can be paid:
– By bank card via real POS terminal in the Administrative services unit;
– In cash on the counter of the Regional administration Veliko Tarnovo;
– By bank on the account below:

– in the Administrative service unit, personally or by an authorized representative;
– through a licensed postal operator at an address, specified by the claimant, whereas the claimant declares that the postal charges are at his/her expense, payable upon receipt.
